Terms and Conditions

§ 1 Scope and Contracting Parties

These General Terms and Conditions apply to the purchase of physical goods from the eMission-X gGmbH wildlife shop at www.emission-x.eco. The seller is eMission-X gGmbH, Sauer Moor 4c, 23845 Oering, Germany, email: info@emission-x.eco, phone: +49 (0)171 275 00 26. These terms and conditions do not apply to pure donations or voluntary contributions without consideration.

§ 2 Conclusion of the Contract

The presentation of goods does not constitute a binding offer. Customers can add products to their shopping cart and review and correct their entries before submitting the order. By clicking the button to place a binding order, they submit a binding offer to purchase. Receipt of the order is confirmed electronically. For payments by bank transfer, the contract is concluded upon our express order confirmation or upon shipment of the goods. For electronic payment methods that trigger immediate payment, the contract may be concluded as soon as the payment transaction is completed or initiated. The automatic order confirmation documents the receipt of the order. The language of the contract is German.

§ 3 Prices and Shipping Costs

The prices displayed in the store apply, including the applicable statutory sales tax. Shipping costs for deliveries within Germany are 10.00 euros net plus 19 percent sales tax, for a total of 11.90 euros gross per package. The total shipping costs for each order are displayed before the order is submitted for payment.

§ 4 Payment

The available payment methods are displayed during the checkout process. These include, in particular, the payment methods offered through PayPal and Stripe. Payment processing depends on the selected payment method.

§ 5 Delivery

Delivery is made exclusively within Germany to the shipping address provided at the time of order. The applicable delivery times are specified in the respective offer or during the ordering process. Your statutory rights in the event of delivery delays remain unaffected.

§ 6 Retention of Title

The delivered goods remain our property until full payment has been received.

§ 7 Right of Withdrawal

Consumers generally have the statutory right of withdrawal for distance sales contracts, unless a statutory exception applies. Details are set forth in the separate notice of withdrawal, which includes a sample withdrawal form. Where required by law, an electronic withdrawal function is also available.

§ 8 Liability for Defects and Warranties

Statutory warranty rights apply. Any additional manufacturer warranties exist independently of these and do not limit the statutory rights against the seller.

§ 9 Liability

We assume unlimited liability in cases of willful misconduct, gross negligence, and injury to life, limb, or health. In cases of slightly negligent breach of material contractual obligations, liability is limited to foreseeable damages typical for this type of contract. Liability under the Product Liability Act and based on expressly assumed warranties remains unaffected.

§ 10 Data Protection

Information regarding the processing of personal data can be found in our Privacy Policy.

§ 11 Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory statutory consumer protection provisions remain unaffected.

§ 12 Final Provisions

Should any individual provisions be invalid, the applicable statutory provisions shall take their place. The validity of the remaining provisions shall remain unaffected.
